For the purposes of this Agreement, the "Restricted Area" means the geographic area within a 75-mile radius of the venue address — [Venue], [Market].

The "Restricted Period" means the period beginning 60 days prior to and 30 days following the Engagement Date, where the Engagement Date is [Engagement Date].

In addition, [Artist] shall not publicly announce, advertise, or place on sale any performance within the Restricted Area occurring during the Restricted Period earlier than 90 days prior to the Engagement Date without the prior written consent of [Purchaser].

[Artist] agrees that, during the Restricted Period and within the Restricted Area, [Artist] shall not perform, appear at, or be advertised in connection with any of the following without the prior written consent of [Purchaser]:

The exclusivity obligations above shall not apply to the following:

Requests for a waiver of this clause shall be submitted in writing to [Purchaser] and shall be responded to within 10 business days. Consent shall not be unreasonably withheld.

[Artist] shall obtain a written waiver from [Purchaser] prior to confirming any conflicting engagement. A breach of this clause without such waiver shall be deemed a material breach of this Agreement.
